As part of our Shared Services group, comprised of Finance, Marketing, Communications, Human Resources, Commercial, Legal and Facilities, we support the business achieve their goals through a range of strong technical capabilities. We ensure delivery of services through the skills of our people, methodologies, and systems.
The position role involves preparing and reviewing commercial proposals, contract formation, client engagement, contractual and commercial terms of agreements, negotiation and conclusion of contracts for studies, consulting, engineering services, procurement and construction management projects, including related subcontracts. Any prior contractual, legal or negotiations experience is an asset. The role also involves educating and training other Hatch team members, from time to time, in base commercial and contractual concepts to supplement business development and project execution activities.
Global CCL team is comprised of professionals with comprehensive experience in commercial and contractual areas, business development, contract formation and contract negotiations. This is an opportunity to become a part of this dynamic global team.
You will be responsible for
• Preparation and review of commercial sections of proposals in accordance with the business requirements and CCL methodologies;
• Contract formation for new contracts;
• Contractual reviews and negotiations of services, EPCM, MSA, Joint Venture, memoranda of understanding, teaming, sub-consultancy, non-disclosure and other agreements;
• Reviews of these and other contractual documents in collaboration with legal counsels of the CCL’s Contracts practice;
• Commercial support of Business Unit and Business Practice leadership, preparation and presentation of commercial and contractual documentation for Global and Sector Pursuit reviews;
• Client Engagement and communication with client supply chain/procurement and legal/contracts teams, developing client relationships with key clients and engaging as required, monitoring business opportunities;
• Comprehensive knowledge of Hatch standard rate schedules, terms and conditions, key pricing and cost recovery models;
• Research of precedents on existing contracts and ensuring consistency in pricing models for key global and regional clients;
• Knowledge of regional standard industry contract forms such as CCDC, NEC etc.
• Knowledge of current and potential future contracting models in the industry such as “Progressive Design Build”, “Integrated Project Delivery”, Target Price, Engineer Procure Construct (EPC) etc..
• Understanding of, and experience in, the North American nuclear industry would be an asset.
• Business intelligence relative to commercial competitiveness;
• Participation in designing CCL Global Commercial Practice’s strategies;
• Proactive assistance and provision of feedback to projects’ Prime Contract Management teams for select projects;
• Interface with Hatch Shared Services teams for Commercial proposals (business opportunities, Pursuit Reviews), Finance (Rates, bonds, exchange rates, costs recoveries, country entity setup), Insurance, Taxation, Mobility (project assignments), Human Resources.
What you bring:
• Bachelor’s degree in Engineering (recommended), Business with Commerce or Law (required);
• Law degree or Master’s degree would be a great asset;
• Strong negotiation skills with clients with the ability to reach strong commercial outcomes; preferablly prime agreements
• Previous contract formation experience (sales side) as a part of commercial or procurement teams preferably in one of Hatch core industry sectors (mining and metals, energy, infrastructure);
• Fluent in spoken and written English;
• 10 + years of commercial or contractual experience with proven accomplishments;
• Excellent business writing and editing skills in English;
• Excellent interpersonal, communications and presentation skills;
• Ability to prioritize and adapt effectively to maintain and manage changing priorities ;
• Ability to develop and analyze commercial / pricing spreadsheet data;
• Strong business acumen and leadership potential with the ability to successfully collaborate with others at all levels of the organization and with counterparties in the client organizations;
• High level of self-motivation and team work with other CCL team members in a pro-active, productive and cooperative manner;
• Expert working knowledge of productivity and business software and tools.
